1. About these terms

These terms govern your use of the Kivoon mobile application and the kivoon.im website (together, the "Service"), operated by Kivoon ("we", "us", "our"). By accessing or using the Service you agree to be bound by these terms. If you do not agree, do not use the Service.

2. The Service

Kivoon is a public transit companion for the Isle of Man. It displays timetables, live bus tracking, journey planning, and related transit information. The Service is provided free of charge.

3. Data accuracy

All transit data displayed in the Service — including timetables, stop locations, real-time positions, and journey plans — is sourced from publicly available information provided by third-party transit operators and public APIs. We do not operate any transit services ourselves.

This data may be inaccurate, incomplete, outdated, or missing entirely. Timetables may not reflect last-minute cancellations, diversions, or schedule changes. Live tracking data depends on third-party feeds that may be delayed or unavailable. Journey plans are calculated estimates and do not guarantee connections.

You should always verify critical travel information directly with the relevant transport operator. Do not rely solely on the Service for time-sensitive or safety-critical travel decisions.

4. No warranty

The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any data displayed will be accurate or complete.

5. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service, including but not limited to:

• Missed connections, journeys, or transport services.
• Reliance on inaccurate, incomplete, or outdated transit data.
• Service interruptions, downtime, or data unavailability.
• Any actions taken based on information provided by the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which, for a free service, is zero).

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the Service, its servers, or connected networks.
• Attempt to gain unauthorised access to any part of the Service.
• Scrape, crawl, or use automated means to extract data from the Service without our written consent.
• Reverse-engineer, decompile, or disassemble the application.

7. Intellectual property

The Service, including its design, code, branding, and original content, is owned by Kivoon and protected by applicable intellectual property laws. Transit data displayed within the Service remains the property of the respective third-party providers.

8. Account and registration

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete registration information.

We may suspend or terminate your account at any time if we reasonably believe you have breached these terms.

9. Third-party services

The Service may contain links to or integrate with third-party services (e.g. transit operator websites, mapping providers). We are not responsible for the content, accuracy, or practices of any third-party service.

10. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you via the Service or our website. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

11. Indemnity

You agree to indemnify and hold harmless Kivoon, its officers, affiliates, and partners from any loss, liability, claim, or demand, including reasonable legal fees, arising out of or relating to your misuse of the Service or your breach of these terms.

12. Termination

You may stop using the Service at any time. We may suspend or discontinue the Service (or any part of it) at any time without notice. Sections 3, 4, 5, 7, 11, and 13 survive termination.

13. Governing law

These terms are governed by and construed in accordance with the laws of the Isle of Man. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Isle of Man.
